Terms of Service

Effective: June 1, 2026

1. Definitions

• SafeGrow: the LiameedS parental control and educational continuity ecosystem.
• Parent User: account holder with legal authority over a child.
• Child Profile: profile created and managed by a Parent User.
• School Entity: school, district, or authorized educational institution.
• Services: apps, cloud APIs, notifications, support, and related infrastructure.

2. Eligibility & Account Responsibility

• You must be legally capable of entering contracts under applicable law.
• Parent Users represent they are a legal guardian or authorized to supervise the child.
• You are responsible for account security, credential confidentiality, and device pairing actions.
• You must provide accurate information and update account data promptly.

3. Child Safety Use & Legal Responsibility

• SafeGrow is designed for lawful child protection and educational support.
• You must use monitoring and filtering features in compliance with local, national, and international law.
• You are solely responsible for obtaining any legally required notices or consents in your jurisdiction.
• In many jurisdictions, monitored individuals (including children above certain ages) must be informed of monitoring. You are responsible for complying with applicable disclosure requirements.
• SafeGrow may suspend or restrict use where abuse, unlawful surveillance, or security risk is detected.

3.1 Device Monitoring Disclosure

The Kids App uses Android Accessibility Service, Device Administrator, Usage Stats, and Background Location permissions. You must disclose this monitoring to the child's device user as required by applicable law. Full permission details: Privacy Policy Section 5.

3.2 AI Features

SafeGrow uses Google Gemini AI to generate parental insights, curriculum recommendations, and reading quizzes. These are advisory only; no legally binding decisions are made solely by automated means. Opt out: privacy@liameeds.com.

3.3 Mobile Messaging Consent (SMS)

• By providing your phone number and opting in, you expressly consent to receive SMS for security alerts, pairing codes, and service notifications.
• Opt out: reply STOP. Help: reply HELP.
• Mobile opt-in data never shared with third parties for marketing.
• SMS consent is not a condition of purchase.
• Carriers are not liable for delayed or undelivered messages.

4. School & District Features (FERPA-aware)

• School Portal is intended for authorized educational purposes only.
• School entities are the data controllers responsible for legal basis and permissions for student data.
• LiameedS commits to deleting student education records within 30 days of termination upon written request.
• Student data is never used for advertising or commercial profiling.
• Schools requiring a formal Data Processing Agreement (DPA): legal@liameeds.com.

5. Privacy, COPPA/GDPR & Child Data COPPA GDPR

• SafeGrow requires a parent account before any child profile is created.
• For children under 13 (US) / 16 (EU/UK): parental authorization required before data collection.
• GDPR legal bases: contract performance, legitimate interest in child safety, and explicit consent where required.

6. Acceptable Use Restrictions

• No unauthorized access, penetration testing, reverse engineering, or exploitation of vulnerabilities.
• No use of SafeGrow to harm minors, evade lawful protections, or violate third-party rights.
• No high-volume scraping, bot abuse, or activity disrupting service availability.
• No monitoring features used beyond what is lawful in your jurisdiction.
• No upload or transmission of unlawful, malicious, or infringing content.

7. Service Changes, Availability & Beta Features

• SafeGrow may introduce, modify, or retire features to improve safety, compliance, and reliability.
• Some features (iOS, Desktop, AI features) may be in Beta and evolve rapidly.
• Uninterrupted operation is not guaranteed.

8. Payments & Subscriptions

• Paid plans described at checkout or in-app offer screens.
• Unless required by law, fees are non-refundable after the billing period begins.
• App-store purchases also governed by platform billing rules (Google Play, Apple App Store).

9. Intellectual Property

• SafeGrow software, branding, and documentation owned by LiameedS, protected by IP law.
• Limited, revocable, non-transferable license to use the Services per these Terms.
• No right to copy, sublicense, resell, or create derivative products from SafeGrow technology.

10. Disclaimers & Limitation of Liability

• Services provided "as is" and "as available," subject to applicable law.
• SafeGrow does not guarantee prevention of all harm, bypass attempts, or third-party outages.
• To the maximum extent permitted by law, LiameedS is not liable for indirect, incidental, special, or consequential damages.
• Nothing excludes non-waivable rights under consumer protection law in your jurisdiction.
• EU/UK consumers: mandatory rights under Directive 2011/83/EU or equivalent UK consumer law are preserved.

11. Indemnification

You agree to defend and indemnify LiameedS, affiliates, and personnel from claims arising from your unlawful use, policy violations, or misuse of monitoring or school features.

12. Suspension & Termination

• You may stop using SafeGrow and request account deletion per our privacy process.
• We may suspend or terminate for material breach, security abuse, legal non-compliance, or fraud risk.
• Liability, IP, dispute, and compliance clauses survive termination.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA. Disputes shall be resolved before competent courts in Delaware, unless mandatory consumer-protection law in your residence requires another forum. EU/UK consumers: mandatory consumer rights are preserved.

14. Changes to These Terms

Material updates communicated via app/email notice at least 30 days before taking effect.
